Welcome to The Cut. By downloading, accessing, or using The Cut's mobile app and services ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
The Cut refers to The Cut LLC, a Colorado limited liability company, the community, the app, and all products/services that it operates.
You must be at least 18 years of age to use The Cut. By using the App, you represent and warrant that you are 18 or older and that you have the legal capacity to enter into these Terms.
The Cut is a members-only community. Access is not guaranteed. To apply for membership, you must complete the sign-up process and submit an application. Once you have advanced through the queue, applications are reviewed by existing members. Submission of an application does not entitle you to membership. The Cut does not interfere with or override member voting outcomes, unless our terms or guidelines are found to be broken. All membership decisions are final.
Upon acceptance, you will be required to pay $249.99 for your first six months of membership (introductory offer). After the introductory period ends, membership auto-renews at a recurring subscription fee of $49.99 per month. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. You may manage or cancel your subscription at any time through your Apple ID subscription settings. All fees are non-refundable, including any unused portion of a subscription period. If your account is terminated for violation of these Terms, you will not receive a refund for any remaining subscription period.
The Cut reserves the right to suspend or permanently terminate your account at any time, for any reason, including but not limited to violation of these Terms or Community Guidelines, behavior deemed harmful to other members, misrepresentation, or conduct inconsistent with the values of the community. Terminated members forfeit any remaining subscription period without refund. Terminated members may be prohibited from reapplying.
You may delete your account at any time via the Settings screen. Upon deletion, your profile and personal data will be permanently removed, subject to the retention exceptions described in our Privacy Policy. If you delete your account, you forfeit any remaining days in your current subscription period. No refunds will be issued.
If your subscription lapses, your account will enter a 30-day grace period. During the grace period, your access to the App is limited. If payment is not received within 30 days, your account and all associated data — including your profile, photos, matches, and messages — will be permanently deleted. If you wish to rejoin after your account has been deleted, you must reapply and go through the full application process. The Cut is not responsible for loss of matches, messages, or connections resulting from a lapsed account.
If your application is not approved, you are welcome to reapply after 12 months from the date of rejection. Reapplication does not guarantee acceptance.
The Cut has zero tolerance for objectionable content and zero tolerance for abusive users. The Cut is a community, and we protect it accordingly.
"Objectionable content" includes, without limitation: hate speech or content attacking people on the basis of race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, age, or any other protected characteristic; harassment, threats, or intimidation of any kind; nudity, sexually explicit content, or pornographic material in profile photos or messages; content depicting, promoting, or facilitating illegal activity; spam, solicitation, or unsolicited commercial content; impersonation of another person or entity; and any content that targets, sexualizes, or depicts minors.
"Abusive user behavior" includes, without limitation: harassment, threats, or intimidation of other members; discrimination on the basis of any protected characteristic; stalking or repeatedly contacting a member after they have indicated they do not wish to be contacted; sending unsolicited sexual content, explicit imagery, or sexually suggestive messages without consent; catfishing or any attempt to deceive other members about your identity, age, appearance, or intentions; repeated or pattern violations of these Terms or our Community Guidelines; and attempting to circumvent account termination, rejection, the 12-month reapplication bar, or any other enforcement action — including by creating a new account with a different phone number or otherwise impersonating a different person to bypass prior removal from The Cut.
The Cut will review all reports of objectionable content or abusive user behavior and take action within 48 hours of receipt. The Cut reserves the right to remove any objectionable content and to permanently terminate the account of any abusive user, with or without prior notice, at our sole discretion. Users terminated under this section forfeit any remaining subscription period without refund and may be permanently prohibited from reapplying.
You may report any member or content that violates these Terms or our Community Guidelines directly within the App using the Report & Block feature, or by emailing report@datethecut.com. Submitting a report through the in-app feature automatically blocks the reported member from further contact with you and removes them from your feed, likes, or active conversations as applicable. This prevents any further contact from that member while we review the report. Reports are taken seriously, reviewed promptly, and acted upon per the 48-hour commitment above.
If The Cut detects that a user has created multiple accounts, used different phone numbers to circumvent enforcement, or impersonated another person, all associated accounts will be terminated without refund, and the underlying person may be permanently barred from The Cut.
In addition to the prohibitions in Section 8, you agree not to: misrepresent your identity or post false information; harass, threaten, or demean other members; share or distribute another member's profile, photos, or personal information outside the App; use the App for any commercial purpose; attempt to manipulate the voting or application process; or engage in any conduct that violates applicable law. Violation of these prohibitions may result in immediate account termination.
By submitting photos or other content to The Cut, you grant The Cut a limited, non-exclusive license to display that content within the App for the purpose of operating the service. You retain ownership of your content. The Cut does not claim ownership over your photos or profile information. This license terminates when your content is removed or your account is deleted.
Your use of the App is also governed by our Privacy Policy and our Community Guidelines, each of which is incorporated into these Terms by reference. A violation of the Community Guidelines is a violation of these Terms and may result in account suspension or permanent termination under Section 4 or Section 8. Please review both documents carefully.
The Cut is provided "as is" and "as available." We make no warranties, express or implied, regarding the App's availability, reliability, or fitness for any particular purpose. We do not guarantee that you will match, meet, or form relationships through the App.
The Cut uses third-party cloud infrastructure and service providers to store and process data. We are not liable for any data loss, breach, or service interruption caused by or attributable to these third-party providers. We take reasonable steps to select reputable providers but cannot guarantee their performance or security.
The Cut facilitates connections between members but does not conduct background checks or verify the identity, intentions, or conduct of its members. We are not responsible for the behavior of members on or off the App, including in connection with any in-person meetings arranged through the App. You assume all risk associated with meeting other members in person. We strongly encourage you to exercise caution and good judgment when meeting anyone you have connected with through the App.
To the maximum extent permitted by applicable law, The Cut and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the App, even if advised of the possibility of such damages. Our total liability to you shall not exceed the amount you paid to us in the three months preceding the claim.
We may update these Terms from time to time. We will notify you of material changes via the App or the contact information associated with your account. Continued use of the App after changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles. Any disputes not subject to arbitration under Section 16 shall be resolved in the courts of competent jurisdiction in Colorado.
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App shall be resolved through binding individual arbitration, not in court. By using the App, you waive the right to participate in any class action lawsuit or class-wide arbitration. Arbitration shall be conducted under the rules of the American Arbitration Association (AAA) in the State of Colorado. Nothing in this section prevents either party from seeking emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.
You agree to indemnify, defend, and hold harmless The Cut LLC and its officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: your use of the App; your conduct toward other members, whether on or off the App; your violation of these Terms; or your violation of any rights of a third party. The Cut reserves the right to assume exclusive control of the defense of any matter subject to indemnification by you, at your expense.
The Cut is not liable for any failure or delay in the performance of the App caused by events beyond its reasonable control, including but not limited to: acts of God, natural disasters, power outages, internet or infrastructure failures, outages of third-party service providers (including cloud hosting, database, or SMS providers), government actions, or any other force majeure event. Service interruptions or outages do not entitle you to refunds, credits, or subscription extensions. The Cut does not guarantee uninterrupted or error-free access to the App.
The Cut respects the intellectual property rights of others and expects users to do the same. If you believe that content on the App infringes your copyright, trademark, or other intellectual property rights, you may submit a notice to our designated agent at dmca@datethecut.com.
A valid notice under the Digital Millennium Copyright Act (DMCA) must include: (a) a physical or electronic signature of the person authorized to act on behalf of the rights owner; (b) identification of the copyrighted work or other intellectual property claimed to have been infringed; (c) identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate it within the App; (d) your contact information (address, telephone number, email); (e) a statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the rights owner, its agent, or the law; and (f) a statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the rights owner.
If content you submitted is removed pursuant to a DMCA notice and you believe the removal was in error, you may submit a counter-notification to the same address containing the same elements listed above, with a statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification, and your consent to the jurisdiction of the federal district court for your judicial district.
The Cut will terminate the accounts of users who are determined to be repeat infringers of intellectual property rights.
